These Terms of Service govern your use of the LUMERA website and your purchase of products from us. By placing an order or using this site, you agree to these terms.

Who we are

LUMERA is an independent cosmetics brand, making colour for lips, eyes and face alongside skincare, hair care and tools.

The business that trades as LUMERA is OZ Sharafi Marketing, registered in Israel, company number 322842444. That registration is the only part of this that is Israeli. It is where the business exists as a legal entity, and it is nothing more than that.

Everything that touches your order is in the United States. The products are manufactured in the United States. They are held, made up, packed and dispatched from our fulfillment facility in Dallas, Texas. Delivery is a domestic United States shipment carried by United States carriers, and we ship within the United States only.

There is one practical consequence of the registration being abroad, and we would rather tell you than let you find it on your statement: a payment to us may show as an international transaction, and your bank may apply a foreign transaction fee if your card carries one. Nothing else changes. Not where your parcel comes from, not how long it takes, not your rights, and not who answers when you email.

Products and pricing

We make reasonable efforts to display our products and prices accurately. We reserve the right to correct pricing errors, limit order quantities, and refuse or cancel any order at our discretion, including after an order has been submitted.

Shade accuracy

Our swatches are taken from the products themselves, but screens vary and skin varies more. A shade will not look identical on your lips to how it looks on your monitor. Please read the shade description before ordering. Our return and refund policy sets out exactly what can and cannot be returned.

Orders and payment

By placing an order, you confirm that the payment and shipping information you provide is accurate and that you are authorised to use the payment method used. Orders are not confirmed until payment is successfully processed.

Product use and disclaimer

Our products are cosmetic items intended for external use only. They are not intended to diagnose, treat, cure, or prevent any disease. Always review the ingredient list before use, which we publish in full on every product page. Discontinue use if irritation occurs, and consult a physician if you have a known skin condition or allergy. We advise performing a patch test prior to full application. LUMERA is not liable for any individual reaction, skin sensitivity, or allergic response to any ingredient.

FDA disclaimer

Statements made regarding our cosmetic products have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Intellectual property

All content on this site, including text, graphics, logos, and images, is the property of LUMERA or its licensors and is protected by applicable intellectual property laws. You may not reproduce or use this content without our written permission.

Limitation of liability

To the fullest extent permitted by law, LUMERA is not liable for any indirect, incidental, or consequential damages arising from your use of our products or this website.

Chargebacks

If something is wrong with your order, email us and we will fix it. That is faster than a chargeback and it always has been. Any unauthorised or fraudulent chargeback request will be disputed and may be referred to the relevant card network along with the associated order and transaction data.

Governing law

These Terms of Service are governed by and construed in accordance with the laws of the State of Israel, which is where the trading entity is registered, without regard to its conflict of law principles.

Nothing in this clause takes away a mandatory consumer protection right you have where you live. If you are a consumer in the United States, you keep every right given to you by applicable United States federal law and by the consumer protection law of your state, including the right to bring a claim there.

Changes to these terms

We may update these Terms of Service from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
